The Australian Government has introduced a new Genuine Student (GS) requirement for student visas, replacing the previous Genuine Temporary Entrant (GTE) requirement. This change applies to student visa applications lodged on or after 23 March 2024. Applications submitted before this date will still be assessed under the GTE requirement.
The GS requirement ensures that all student visa applicants are genuine in their intention to study in Australia. Applicants must demonstrate that their primary purpose for holding a student visa is to pursue education in Australia. This requirement also encourages students who develop skills needed by Australia during their studies to apply for permanent residency afterward.
To be granted a student visa, applicants must meet the genuine student criterion, which is evaluated based on their responses to several questions in the online visa application form. These questions include:
- Current circumstances: Details about the applicant’s family, community ties, employment, and economic situation.
- Course selection: Explanation of why the applicant chose a particular course and education provider in Australia, including their understanding of the course requirements and the experience of studying and living in Australia.
- Course benefits: How completing the course will benefit the applicant in the future.
- Additional information: Any other relevant details the applicant wishes to include.
Applicants who have previously held a student visa or are applying for a student visa in Australia from a non-student visa are required to answer an additional question. Along with the application responses, applicants must also attach supporting documents to their ImmiAccount. Generic statements without evidence will not carry significant weight in the GS assessment, making it crucial for applicants to provide detailed and substantiated information.
When assessing the GS requirement, the applicant’s overall personal circumstances are taken into consideration, including:.
- Previous study: Academic transcripts, qualifications, and certificates, along with details about any previous study in Australia, including reasons for changing courses or education providers, study gaps, and course progress.
- Current employment: Information about current employment, including the employer’s details, length of employment, and position held, with a contact person who can verify the employment.
- Circumstances in the home country or country of residence: The nature of personal ties, economic conditions, and any reasons for not studying in their home country if similar courses are available. Documentation might include employment records, potential job offers, and tax returns.
- Potential situation in Australia: The applicant’s knowledge of the proposed course, education provider, and living conditions in Australia, as well as the relevance of the course to their career prospects in their home country or elsewhere.
- Course value: Whether the course aligns with the applicant’s educational background and career goals, and how it may enhance their employment opportunities and salary prospects.
- Immigration history: The applicant’s visa and travel history, including previous visa applications, refusals, or cancellations for Australia or other countries.
For applicants who are minors, the intentions of their parents, legal guardians, or spouse will also be considered. Additionally, any other relevant information that the applicant wishes to include will be taken into account during the assessment process.
This new GS criterion aims to ensure that students coming to Australia are genuinely committed to their studies and have thoroughly considered their educational and future career paths.
